Hazardous Waste Permits
Permits are required for those who treat, store, or dispose of hazardous waste before any activities occur. Certain exemptions are available for large and small quantity generators. Emergency permits can also be obtained under specific circumstances.

Under the Rules, solid wastes are considered hazardous if they exhibit defined characteristics (ignitability, corrosivity, reactivity, or toxicity) or are listed by specific name and waste code due to other physical or chemical properties. Wastes derived from the treatment, storage, or disposal of hazardous wastes and mixtures of non-hazardous waste and hazardous wastes are also regulated.
To begin the process, contact the Division to make sure you understand what will be required under an application.
When you've completed an application, the Division will review it. Additional information may be requested. Once the review is complete, either a draft permit or a denial will be issued. Draft permits are subject to at least 45 days of public comment and a public hearing. Permit applications must be processed within one year, excluding time spent waiting for applicant responses, public participation, or review by other federal or state agencies.
- Fees range from $50,000 to $200,000 for hazardous waste permits, depending upon the type of facility.
- Additional review fees will be assessed, based upon type of application and time needed to complete it.
- Fees are also charged for permit modifications.
Hazardous waste storage permits typically take 12-18 months to process. Treatment and disposal permits are more complex and take longer.
Hazardous waste permits can be valid for up to 10 years. All permits may be modified or revoked when warranted.
