Utah E-Bike Program

To meet the Income-Qualified voucher requirements, your gross household income must be at or below 60% of Area Median Income (AMI).

This table is Salt Lake County's Area Median Income (AMI) but amounts will vary by county.

Confirm understanding of the Participant Support Cost Terms & Conditions Agreement (Agreement), which includes program rules and a termination clause. This is a voucher (Participant Support Cost) provided through funding from a federal grant awarded to the Utah Division of Air Quality from the Environmental Protection Agency (EPA). The Utah Division of Air Quality will disburse Participant Support Cost funds as vouchers for actual eligible costs only in accordance with the conditions set forth in this Agreement. This Agreement is between me, the Program Beneficiary, and the Utah Division of Air Quality.

1. I understand that participation in this program is subject to eligibility, funding limits, and compliance with all program rules.

2. I agree not to purchase an e-bike until I have received formal written approval and the voucher code from Utah Division of Air Quality (UDAQ).

3. I understand that the initial program eligibility confirmation (program pre-appoval) expires 14 days after receipt of the approval email.

4. I understand that program eligibility confirmation is based on submitting this application and agreeing to these terms and conditions.

5. I understand that this program provides vouchers to approved participants for an e-bike purchased from approved participating vendors in Utah.

6. I understand that the final program voucher confirmation (program approval) expires 14 days after receipt of the voucher email. I automatically forfeit my voucher if I have not made the e-bike purchase after 14 days.

7. I understand that program purchases are final and that returns of e-bikes are not allowed, except for products with manufacturing defects, which are exchanged for equivalent products.

8. I, the Program Beneficiary, shall comply with the following requirements:

   1. Any costs incurred by me, the Program Beneficiary, under this Agreement, must be reasonable and adhere to 2 CFR § 200.404.  An example of reasonable costs is commercially off-the-shelf items purchased at a reasonable market rate.

   2. The intention of this Participant Support Cost is to reduce greenhouse gas emissions. Accordingly, I, as the Program Beneficiary, shall keep the e-bike and materials obtained via Participant Support Costs in good working order. I agree to retain ownership of the e-bike purchased for at least 10 years from the date of purchase and use it for transportation purposes.

   3. This Agreement is effective on the date it is submitted by me. I will comply with all federal, state, and local laws, regulations, executive orders, and ordinances applicable to this Agreement.

9. I, the Program Beneficiary, shall comply with the following safety requirements:

   1. I agree to practice good judgement and ride my e-bike responsibly.

   2. I certify that I am 18 years of age or older, am not legally restricted from operating an e-bike, and will use the voucher only for an e-bike for my personal use and ownership.

   3. I certify that I will not authorize or knowingly permit an individual to operate my e-bike, if purchased for myself, who is under the age of 8, or under the age of 16 without my supervision.

   4. I agree that it is my sole responsibility to know and comply with all applicable state and local laws related to my ownership and operation of the e-bike purchased through this program, including but not limited to:

      1. E-bike use limitations for those that are age 16 and younger;

      2. Helmet requirements for e-bike riders under 21 when riding on public roads (not paths).

10. Any and all equipment or materials purchased with funds made available by this Agreement must be used in accordance with this Agreement (e.g., it must be kept in good working order and ownership must be retained for 10 years).

Written Voucher Agreement and Termination Clause

All participants agree to a standard set of terms and conditions during pre-approval. The written Agreement also includes the following termination clause:

• This Agreement may be terminated with cause, by either party, with 10-day notice and an opportunity to cure, or without cause for unavailability of funding, by UDAQ, with a 10-day written notice.

• Upon termination, the participant is entitled to funding for purchases properly made before the termination date, which is the date when the notice becomes effective (i.e., a 10-day notice becomes effective 10 days after UDAQ or the participant sends it). UDAQ is not liable for unauthorized purchases and will not provide funding for those purchases.

•  Immediately, if the EPA terminates federal funding without notice. If EPA gives advance notice of termination, this Agreement will be terminated with the same advance 10-day notice.

Participation is open to Utah residents who meet the following requirements:

• You must live in one of the designated counties: Davis, Salt Lake, Tooele, Weber,  or Utah County

• You must be at least 18 years old

• You must apply and be approved to participate

• After you apply and get approved, you must watch the required safety video and agree to safety information.
• After submission of that, you will then be sent your voucher information and must purchase the e-bike at one of the approved stores within 2 weeks.

No, the requirements around e-bikes are different than e-motorcycles and other motor vehicles.

To be considered an e-bike in Utah, a device must:

• Have operable pedals
• Be 750 watts or less
• Follow Class 1, 2, or 3 definitions

Devices that exceed 750 watts or can go over 20 mph using the throttle alone are not e-bikes and may be regulated as motor vehicles. This includes driver license, motorcycle endorsement, and insurance requirements.
