Air Quality Rule and Plan Changes Open for Public Comment

Rule R307-230, NOx Emission Limits for Natural Gas-Fired Water Heaters, 110(l) Demonstration Public Review

Rule R307-230 was adopted in 2018 as a statewide control measure for oxides of nitrogen (NOx) for natural gas-fired water heaters. In August 2025, the rule was amended to apply only in areas designated nonattainment for ozone or particulate matter. A Section 110(l) Demonstration was not included with the rule revision and is now being provided for public review. The demonstration evaluates ambient pollutant concentrations and projected changes in emissions resulting from the revision and concludes that the revision will not interfere with attainment or reasonable further progress toward the National Ambient Air Quality Standards, or with any other applicable requirement of the Clean Air Act.

The Division is providing an opportunity to review this 110(l) Demonstration. Comments will be accepted from September 1, 2026, through October 1, 2026, and may be sent to [email protected].
