Perpetual Care of Commercial Hazardous and Radioactive Waste Treatment, Storage, and Disposal Facilities (Five-Year Review)

DEQ has submitted to the Legislative Management Committee its report on the Five-Year Review of Financial Assurance and Perpetual Care of Commercial Hazardous Waste and Radioactive Waste Treatment, Storage, and Disposal Facilities.

In 2005, the Utah Legislature passed a bill requiring both the Solid and Hazardous Waste Control Board and the Radiation Control Board to prepare and submit a report evaluating the adequacy of funding and financial assurances provided for the closure, post-closure, and perpetual care and maintenance of commercial hazardous waste and radioactive waste treatment, storage, and disposal facilities. (See UCA §19-1-307.)

The initial report was completed in 2006. Every five years an updated evaluation is to be completed by both Boards and submitted jointly by October 1 to the Legislative Management Committee. The 2011 report is available for review online (4 MB).
